What does the leave vote mean for European Citizens?

There will be a lot of panic today from many EEA nationals who are concerned about their prospects and future in the UK. It is inevitable that the UK will eventually introduce immigration control and all European nationals from EEA countries will be classed similar to Non-eea nationals and require a visa to work and live in the UK. When this will happen is not clear, but it is important that EEA nationals and their family members secure their EEA PR as soon as they can. What can I do to continue working in the UK as an EEA National?

If you are from an EEA country you need to apply for a document certifying (Form QP) residence or EEA PR. It is advised you submit an application ASAP for confirmation of EEA PR or residence. There will be a massive rush from millions of EEA nationals to apply for these documents. Currently, it is taking up to 6 months to process an application for permanent residence. With the huge increase in applications, this may extend the processing time to as long as 12 months or more. It is unlikely the Home Office are going to speed up the process or put more staff into processing EEA Applications given that the country is leaving the EEA area. For this reason, it is essential that you obtain professional and expert advice with your EEA Permanent Residence application to ensure it does not come back rejected. If you apply and it is rejected, even for a minor error it may not give you enough time to correct the problem before the new immigration rules are implemented.

How Long Will My EEA PR Application Take?

Currently, we are seeing extremely long wait times. There is no phone number to discuss your current application with the Home Office so all communication is required by mail correspondence. This takes a long time and is why applications should be prepared correctly from the start. Before the Brexit (vote leave) there was a wait time of around 6 months for applications for permanent residence from EEA citizens. We can now expect this delay to be even longer with some speculation that with millions of potential applications that delays could be as long as 12 months to 2 years. If you consider that this means a mistake could result in a refusal and by the time your application is processed it may be too late to reapply. This can lead to job losses, children having to leave school and return home and many other hardships for EEA migrants.

  1. Hello I submitted my application for EEA PR on 22nd January2016. I received biometric requirement letter on 9th March.
    With the Brexit issue now hovering does it mean I may have to wait till end November or even next year?

    1. Hi Frank, as you have already submitted your application for EEA Permanent Residence you will at least be in the front of the queue. You should expect to have it processed within the next few months, but certainly anyone who has just sent an application could expect very long delays due to the unprecedented amount of applications. The Home Office may not have prepared for this situation and not have enough staff to handle the volume of applications. Due to these delays it’s very important that EEA nationals seek advice before submitting their PR application to avoid any further delays or risks to their ability to stay in the UK.
